End-User License Agreement

 

 

Use of the QuickCrypto Software is subject to the following terms and conditions.  If you do not accept these terms, you must cease use of the Software.  Continued use of the Software indicates acceptance of these terms.

 

Ownership of the Software

 

1. The QuickCrypto Software ("the Software") and the accompanying files are owned by Cybernescence Limited ("the Company") and are protected by United Kingdom copyright laws, by laws of other nations, and by international treaties.

 

 

Limited Warranty

 

Every effort has been made to make this software as complete and as error free as possible, but no warranty of fitness is implied.

 

2. The Software is provided "as is".  The Company disclaims all warranties, either express, statutory or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.  The entire risk for the use of the Software is assumed by the user. THE COMPANY DOES NOT WARRANT THAT THE SOFTWARE OR ITS FUNCTIONS WILL MEET YOUR REQUIREMENTS OR THAT THE OPERATION OF THE SOFTWARE WILL BE UNINTERRUPTED OR ERROR FREE OR THAT ANY DEFECTS WILL BE CORRECTED.

 

3. The Company does not assume liability for damages, including loss of profit, lost savings, damage to equipment or data, or other incidental or consequential damages arising out of the use or inability to use the Software, EVEN IF THE COMPANY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

 

4. The Company's entire liability and your exclusive remedy shall be return of the price paid for the Software.

 

5. This Limited Warranty is void if failure of the Software has resulted from modification, accident, abuse, or misapplication.

 

 

Restrictions on Use

 

6. The Company grants the right for a single user to use the Software on a single machine.  You may install the Software on more than one computer provided that you have purchased sufficient licenses.  Network installation is also only permitted if you have purchased licenses sufficient to cover the number of copies concurrently in use.  You may make backup copies of the Software for your personal use only.

 

7. You may not reverse engineer, decompile, or disassemble the Software.  You may not modify the Software in any manner.

 

8. You may permanently transfer the Software if you retain no copies and the transferee agrees to be bound by the terms of this Agreement.  Such a transfer terminates your license.  You may not rent or lease the Software or otherwise transfer or assign the right to use the Software, except as stated in this paragraph.

 

9. You may not copy the Software, except that you may make a copy of the Software solely for backup or archival purposes, and except as stated in the next paragraph.

 

10. The trial version of the Software may be freely distributed under the conditions that it is not modified in any way and that no remuneration, monetary or otherwise, is received for the trial version.  For more information concerning distribution of the trial version of the Software, see Distribution Agreement.

 

 

Other Rights

 

11. The Company provides free technical support by email to users of the Software. However, the Company reserves the right to terminate support to users with unusual system problems beyond the scope of the Software and to users requesting support for 3rd-party products (such as the Windows operating system).

 

12. The Company reserves all rights not specifically granted in this license.

 

13. This Agreement is governed by the laws of England & Wales, United Kingdom.

 

14. Notice to U.S. Government End Users. The Software and Documentation are "Commercial Items," as that term is defined at 48 C.F.R. §2.101, consisting of "Commercial Computer Software" and "Commercial Computer Software Documentation," as such terms are used in 48 C.F.R. §12.212 or 48 C.F.R. §227.7202, as applicable. Consistent with 48 C.F.R. §12.212 or 48 C.F.R. §§227.7202-1 through 227.7202-4, as applicable, the Commercial Computer Software and Commercial Computer Software Documentation are being licensed to U.S. Government end users (a) only as Commercial Items and (b) with only those rights as are granted to all other end users pursuant to the terms and conditions herein. 15. THIS PRODUCT MAY INCORPORATE IMPLEMENTATIONS OF CRYPTOGRAPHIC ALGORITHMS THAT ARE REGULATED (E.G. SUBJECT TO EXPORT/IMPORT CONTROL REGULATIONS) OR ILLEGAL IN SOME COUNTRIES. IT IS SOLELY YOUR RESPONSIBILITY TO VERIFY THAT IT IS LEGAL TO IMPORT AND/OR USE THIS PRODUCT (OR PORTIONS THEREOF) IN COUNTRIES WHERE YOU INTEND TO USE IT, AND IT IS SOLELY YOUR RESPONSIBILITY TO COMPLY WITH ANY APPLICABLE REGULATIONS, RESTRICTIONS, AND LAW. YOU MUST REMEMBER THE PASS PHRASES (PASSWORDS) AND PROTECT KEY FILES USED TO ENCRYPT FILES & TEXT - NO ONE CAN RECOVER THE ENCRYPTED INFORMATION IF YOU FORGET OR LOSE THESE.

 

 

Distribution Agreement

 

The following information is intended for vendors who wish to distribute the trial version of the Software.  The company encourages free distribution of the trial version in its original unmodified form.  For information on conditions for use of the Software, see the above End User License Agreement.

 

The trial version of the Software is defined as the original trial package without any registration keys or modifications.

 

The Company grants the rights to distribute the trial version of the Software only under the following conditions.

 

 

Software Distribution

 

16. Under NO circumstances may you distribute any modified version of the Software.  Any distribution of the Software must include all unmodified files found in the original package, including programs, documentation, and sample data files.

 

17. Under NO circumstances may you wrap the Software within another software package, add files to the software package, or install it in conjunction with other software.

 

18. Under NO circumstances may you distribute a registered version of the Software or any registration keys which can be used to convert a trial version of the Software into a registered version.

 

19. Any vendor distributing the Software must prominently display a statement properly defining the shareware or "try-before-you-buy" distribution method.  This applies to all physical and electronic distribution methods.

 

20. Any vendor distributing the Software may not charge a fee for media and distribution costs that is exclusively for the trial version of the Software.  This applies to all physical and electronic distribution methods.

 

21. Any commercial vendor distributing the Software must inform the Company of its intention to do so.  Commercial vendor is defined as anyone distributing the Software for remuneration, monetary or otherwise.

 

22. The company reserves the right to revoke any permission granted here at any time.

 

 

IF YOU ARE NOT SURE WHETHER YOU UNDERSTAND ALL PARTS OF THIS LICENSE OR IF YOU ARE NOT SURE WHETHER YOU CAN COMPLY WITH ALL TERMS AND CONDITIONS OF THIS LICENSE, YOU MUST NOT USE, COPY, MODIFY, NOR (RE)DISTRIBUTE THIS PRODUCT, NOR ANY PORTION(S) OF IT. YOU SHOULD CONSULT WITH A LAWYER.
